AREAS OF PRACTICE

Throughout a career spanning more than 30 years, Arnold has represented a variety of clients in all industries in business related matters, including business transactions and corporate restructuring, both in and out of bankruptcy.  

Arnold has substantial corporate experience, including mergers and acquisitions, structured finance (credit card receivables, mortgage-backed securities, real estate lease receivables), project finance, and securities. He also has represented clients in the acquisition of several Chinese manufacturing companies.

Arnold has also represented debtors, creditors, official and unofficial creditor committees and liquidating trusts in the restructuring and bankruptcy process.   He has substantial experience in restructuring overseas debtors and bond debt.

 

PREVIOUS EXPERIENCE

Prior to founding Gulkowitz Berger LLP, Arnold was a partner at Dickstein Shapiro LLP for more than 8 years, and at Orrick, Herrington & Sutcliffe LLP for more than 14 years.  Previously, he was an associate at Cahill Gordon & Reindel LLP; Cadwalader, Wickersham & Taft LLP; and Milbank, Tweed, Hadley & McCloy LLP.

 

REPRESENTATIVE MATTERS

· Petra Fund REIT Corp. (and a related affiliate) in a highly litigious bankruptcy proceeding in the Southern District of New York to a successful Chapter 11 confirmation.

· The official creditors’ Committee in Reliance Group Holdings, Inc., one of the largest bankruptcy cases of the last decade, in the insurance company’s restructuring.  Arnold’s successful representation increased bond values more than 2500 percent.  After confirmation, the Official Committee appointed him as counsel to the RGH Liquidating Trust, which he continues to represent.

· Mayora, the largest agricultural company in Indonesia, successfully restructuring their entire debt.

· The bondholders of Ometraco in Indonesian liquidation, for whom  Arnold successfully received substantial liquidation proceeds after the bondholders were originally denied any recovery.

· Committees and creditors in Tudor Oaks, Cybercash, Lehman, Comdisco, Geneva Steel, Amerco, Golden Ocean, JTS, Koger Properties, Hadson, and others in numerous major bankruptcies.

 

PROFESSIONAL ACTIVITIES

Arnold is a member of the New York State Bar Association and is a Certified Public Accountant.
